EXPLANATORY NOTE


The alarming rate of women and babies dying during and after birth underscores the need to provide extra assistance to the very foundation of the society- the family.
It is so ironic that the state produce medical professionals like nurses, pharmacists, medical technologists; etc but adequate and quality service is hardly and is seldom rendered. There is a need to extensively promote proper assistance and caring to a woman and the helpless child on his womb at this crucial stage. We all believe saying The health of the people is the wealth of the nation but this was never realized.
This bill shall promote women and babies empowerment through providing health and medical assistance. Families whose annual income is below One Hundred Thousand Pesos (P100,000.00) would generally benefit from this bill.

AN ACT PROVIDING HOSPITALIZATION ASSISTANCE TO
LABORI NG WOMEN AND THEIR FAMILIES

Be it enacted by the Senate and the House of representatives of the Philippines in 4.Congress assembled.

SECTION 1. Short title- This act shall be known as the “Laboring Women 6.Hospitalization Assistance Act”

SECTION 2. Declaration of Policy- It is hereby declared the policy of the state to ensure the sustainable use, development, and management of medical resources for the welfare of the pregnant and laboring women belonging to families whose monthly
income would not exceed to One Hundred Thousand Pesos (P100,000.00). The state shall protect and enhance the quality of medical appropriation and provide equitable access to these resources.

SECTION 3. Concept- This act gives 65% deductible from private hospital charges to laboring women who are eligible as to the standard qualification set thereof during 4th and succeeding pregnancy on private hospitals.

SECTION 4. Mandate- This At shall be the primary medical assistance move for 17.laboring women belonging to below One Hundred Thousand Pesos (P100,000.00) 18.families income earners.

SECTION 5. Function- In pursuit of its concept and mandate, this act shall have the 20followinf functions:

a. Empower of women.
b. Provide quality and adequate hospitalization assistance.
c. Promote healthy environment through healthy people.
d. Support families earning below One Hundred Thousand Pesos (P100,000.00).

SECTION 6. Sanction for non-compliance- Private hospitals who fail to comply and refuse to accept patience eligible for the hospitalization assistance and ask for full payment hospital charges including the 65% deductible shall be reprimanded on the. first two (2) non-compliance and issuance of non-operation and closure of the business on the third offence. Reoperation of business shall only be possible after payment of Seven hundred Fifty thousand Pesos (P700,000.00) for every reported non-compliance case including the First two cases.

SECTION 7. Transitory Provision- The secretary of Department of Health shall oversee the implementation of this act within ninety (90) days after is affectivity.

SECTION 8. Appropriations- The amount for the implementation of this Act Shall be taken from the current fiscal appropriations of the Department of Health. The succeeding appropriations shall be included in the General Appropriations Act for the fiscal year
immediately following affectivity if this act and every year thereafter.

SECTION 9. Separability Clause- If for any cause, any part of this act is declared unconstitutional, the rest of the provisions shall remain in force and effect.

SECTION 10. Repealing Clause- All Acts, decrees, general orders, letters of instructions, regulations, and circulations, or parts thereof inconsistent with any provision of this Act are herby repealed of modified accordingly.

SECTION 11. Effectivity- This act shall take effect Fifteen (15) days after its 44.publication in two newspapers of general circulation.
