EXPLANATORY NOTE

The State recognizes that stalking violates the right of every person to privacy.

The Constitution upholding the human rights and the dignity of every person and the right of the people to be secure in their persons, houses, papers, against unreasonable searches and seizures of whatever nature and for any purpose really states that stalking is unlawful.

Letting this act to continue, Stalking may cause several kinds of crime. It may lead to an increase of the number of cases of rape, kidnapping, car napping, theft, murder or the likes. Thus, we should be alarmed by this act of harassing, bothering, frightening, or threatening the private lives of the people.

Hence, this bill seeks to define further and penalize the acts constituting the crime of stalking for it may cause more crimes.

AN ACT DEFINING THE CRIME OF STALKING AND PROVIDING PENALTIES THEREFOR

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

SECTION 1. SHORT TITLE - It shall be known as the “ANTI-STALKING ACT”.

SECTION 2. DEFINITION of TERMS
a. “Harasses” would mean an engage in a knowing and willful conduct that –
1. is directed to a particular person
2. seriously alarms, disturbs, or terrorizes the person
3. has no legitimate purpose; and
4. would case substantial emotional stress to the person
b. “Course of conduct” would mean a series of acts aver a period of time.
c. “Credible threat’ would mean a threat that has an intention to cause fear to the person about his or her safety. And it is against the life of or would cause injury to the person.

SECTION 3. PUNISHABLE ACTS – a person commits stalking when he or she harasses another by:
a. Making repeated unsolicited telephone calls without any purpose;
b. Visiting the victim’s home or workplace repeatedly;
c. Following the victim in public place or places; or
d. Any other course of alarming conduct

SECTION 4. PENALTY – any person who evidently commits the acts mentioned in Section 3 shall be punished with imprisonment or a fine ranging from P 1 000.00 – P10 000.00 depending on the weight of the committed act.

SECTION 5. SEPARABILITY CLAUSE – if any provision or part hereof is held invalid or unconstitutional, the remaining provisions that are not affected shall remain valid and constitutional.

SECTION 6. REPEALING CLAUSE – all laws, decrees, rules and regulations, or part hereof inconsistent with any of the provisions of this act is hereby repealed, amended, or modified accordingly.

SECTION 7. EFFECTIVITY CLAUSE – this shall take effect thirty- (30) days after its publication in at least two (2) newspaper of general circulation.
