EXPLANATORY NOTE


This bill seeks to amend certain sections of the Government Service Insurance Act of 1997. The Primordial intent of this is to replace the retirement age of government employees to sixty (60) years of age.
This age is no longer suited to the present labor and demographics country. Their service is no longer effective. The reason for this change is to lessen the unemployment rate. It will also one way to open an opportunity for those job-seekers to have a career in government agencies.
Replacing the age requirement for retiring government employees would be a positive step towards balancing the scales towards productivity. In return to their loyalty and hardworking they will receive retirement benefits that they deserved.
The approval of this measure is earnestly sought.

AN ACT
AMENDING THE PRESIDENTIAL DECREE NO. 1146, OTHERWISE KNOWN AS THE REVISED GOVERNMENT SERVICE INSURANCE SYSTEM ACT OF 1997, BY REPLACING THE AGE REQUIREMENT OF GOVERMENT EMPLOYEES FOR RETIREMENT AND MAKE IT AS MANDATORY TO ALL GOVERNMENT AGENCIES

Be it enacted by the senate and the House of Representatives of the Philippine Congress assemble.

SECTION 1. Section 13 –B of Presidential Decree no.1146, otherwise known as the "Revised Government Service Insurance Act of 1997" is hereby amended. To read as 3.follows:
“SEC. 13 RETIREMENT BENEFITS
(a) Retirement Benefit shall be-
(1.) the lump sum payment as defined in the act payable of the time of retirement plus. An old age pension benefit equal to the basic monthly for life, starting upon expiration. Of the five-year (5) guaranteed period covered by the lump sum; or
(2) Cash payment equivalent to eighteen (18) months of his basic monthly pension plus .monthly pension for life payable immediately with no five-year (5) guarantees.
(b) Unless the service is extended by appropriate authorities, retirement shall be compulsory for an employee at least sixty (60) years of age with at least fifteen (15) years of service. Provided, that if he has less than fifteen (15) years of service, he may be allowed to continue in the service in accordance with existing civil service rules and regulations.

SECTION.2 A member who retires from the service shall be entitled for the retirement benefits enumerated in paragraph (a) of Section 13 hereof. Provided that:
He has rendered at least fifteen (15) years of service;
He is at least sixty (60) years of age at the time of retirement; and
He is not receiving a monthly pension benefit from permanent total disability.

SECTION 3. There will be a compulsory retirement stated in paragraph B of Section 13, for those employees whose sixty (60) years of age and more than fifteen (15) years in the service.

SECTION 4. Repealing clause- All laws, acts ,decrees, executive orders, rules and regulations or other issuance or parts thereof are inconsistent with this act are hereby modified and repealed.

SECTION 5. This act shall take upon its approval.
