Explanatory Note


The 1987 Constitution in Section 2, Article II, states that “the state recognizes the sanctity of the family life and shall protect and strengthen the family as a basic autonomous social institution. It shall equally protect the life of the mother and life of the unborn from conception the natural and primary right of the parents in rearing of the youth in civil efficiency and development of moral character shall receive support from the Government.
However the declared principles are hampered by significant and far-reaching social problems that need attention- irresponsible parenthood, rapid growth of population, unwanted pregnancies, reproductive health and family planning, education, employment, medical health care, spirituality and value formation, juvenile delinquency and housing.
In every citizen, everything that happens inside their home greatly affects their lives. Studies have claimed that a person’s attitudes, beliefs, principles and even his status in life reflect on the family that he/she have.
This bill seeks to intensify the family program of the government and reduce the hampering social problems, creating a commission that would focus greatly on the welfare of the Filipino Family.

AN ACT CREATING A NATIONAL POPULATION AND FAMILY COMMISION AND PROVIDING FUNDS THEREOF, AND FOR OTHER PURPOSES.

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled;

Section 1. Short title. This act shall be known as “Population and Family Commission Act of 2007”.

Section 2. Declaration of Policy. The following State policies shall be observed at all times.

a) The state recognizes the sanctity of the family life and shall protect and strengthen the family as a basic autonomous social institution. It shall equally protect the life of the mother and life of the unborn from conception the natural and primary right of the parents in rearing of the youth in civil efficiency and development of moral character shall receive support from the Government.
b) The state recognizes the Filipino family as the foundation of the nation. accordingly, it shall strengthen it’s solidarity and actively promote it’s total development.

Section 3.Creation. There is hereby created a National Population and Family Planning Commission that will cater the needs of the Filipino family and seek a holistic approach to search for a long term solutions to social problems facing the Filipino Family. The commission is attached to the office of the President.

Section 4.Officers. The Commission shall have composed of the following:
a) Chairman of The Commission
b) Representative OF Department of Justice
c) Representative of Department of Health
d) Representative of Department of Labor and Employment
e) Representative of NEDA
f) Representative of National Youth Commission
g) Representative of Women Commission
h) Representative of Department of Social Welfare and Development
i) Representative of Department of Interior and Local government.
j) Representatives from Religious Organizations.;

Section 5. Function of the Commission. To seek a long term solution to the various social problems of the Filipino Family. Create and implement programmatic approaches for the Filipino Family.

Section 6. Appropriations. - There is hereby authorized to be appropriated the amount of Fifty million pesos (P50,000,000) as additional funding for the Commission, to be charged against the unexpended contingency funds of the Office of the President.

Section 7. Separability Clause. - If for any reason or reasons, any part or provision of this Act shall be held to be unconstitutional or invalid, other parts or provisions thereof not affected thereby shall continue to be in full force and effect.

Section 8. Repealing Clause.- any law, presidential decrees or issuance, executive order, rule or regulation contrary to or inconsistent with, the provisions of this act is hereby repealed, modified or amended accordingly.

Section 9. Effectivity Clause. – This Act shall take effect upon its publication in at least one (1) national newspaper of general circulation.
