EXPLANATORY NOTE
The continuing degradation of the Philippines environment has become a national concern. The uncontrolled injury and/ or damage in the environment, not only endanger the properties, protection of life, health and safety of the people but it also inhibits social and economical development of the country.
Endangering the safety of the people and of the Commonwealth because of the continuing degradation of the environment can be considered as a crime. This also violates Section 16, Article 2 of the constitution which states that,” The State shall protect and advance the right of the people to a balance and healthful ecology in accord with the rhythm and harmony of nature.
Thus, in order to execute the states duty to enact laws that will effectively respond to environmental problems besetting our country and for the protection of the interest of public health and safety, this bill seeks to penalize the illegal dumping or throwing of waste onto highways or public or private properties or simply the act of littering.
In view thereof, the early passage of this proposed measure is highly recommended.

AN ACT
PENALIZING THE ILLEGAL DUMPING, THROWING OR SIMPLY THE ACT OF LITTERING ALL SHAPES AND SIZES OF WASTE OR REFUSE, OR ANY DETRIMENTAL OR DANGEROUS SUBSTANCES UPON ANY HIGHWAYS, OR UPON ANY PUBLIC OR PRIVATE PROPERTIES
Be if enacted by the Senate and House of Representatives of the Philippines in
Congress assembled:
SECTION 1. Short Title. - This Act shall be known as the “Anti- Littering Act”.
SECTION 2. Declaration of Policy. – It is hereby declared the policy of the state to promote the natural balance and protection of the environment for the advancement and protection of human life, health and safety.
SECTION 3. Definition of Terms. – For the purpose of this act, the term:
(1). “Littering” – the act of illegal dumping or throwing all shapes and sizes of waste or refuse, or any detrimental or dangerous substances.
(2). “public properties” – establishments, roads, highways and other places that are owned by the republic or government and were opened and used by the public.
(3) “Private Properties” – establishments, road, highways and other places or properties that are privately owned and are not properties of the republic.
(4). “Waste or Refuse” – includes all forms, shapes and sizes of garbage or waste and detrimental or dangerous substances.
SECTION 4. Prohibited Acts. – No Person shall, at any times, throw or illegally dump upon any highways, or upon any public or private properties any waste or refuse, or any dangerous or detrimental substances of all shapes and sizes for the purpose of dumping, unless such person throw or dump such waste at places provided by the law.
SECTION 5. Penalties. – Any person violating this Act commits a summary offense and shall, upon conviction, be sentenced to either or both of the following:
(1). To pay the amount not less than Five Hundred Pesos (500.00) nor more than Five Thousand Pesos (5,000.00) or
(2) Imprisonment of not less than 3 weeks but not more than 90 days;
(3) If the offense was committed by a minor (person below legal age, 18), the penalty shall be imposed to parents or guardian of such minor offender.
SECTION 6. Implementing Rules and Regulations. – The Department of Environment and Natural Resources and the Local Government Units shall jointly issue the rules and regulations for effective implementation of this Act with in ninety days (90) after its approval. Not later than six months (6) after the date of effectivity, the department shall submit a report to the Congress. The report required under this section shall contain an accounting and evaluation of the implementation of this Act.
SECTION 7. Separability Clause. - Any law, presidential decree or issuance,
executive order, letter of instruction, administrative order, rule or regulation
contrary to or inconsistent with the provisions of this Act is hereby repealed,
modified, or amended accordingly.
SECTION 8. Repealing Clause. - Any law, presidential decree or issuance,
executive order, letter of instruction, administrative order, rule or regulation
contrary to or inconsistent with the provisions of this Act is hereby repealed,
modified or amended accordingly.
SECTION 9. Effectivity. - This Act shall take effect fifteen (15) days after its
publication in at least two (2) newspapers of general circulation.
