EXPLANATORY NOTE

The Philippine in terms of imposing penalty is vengeful, which enunciates the old system of sanction simplified as “ eye for an eye”, a “tooth for a tooth” That is contradictory to the higher values of law and justice. The state must execute punishment but not answer the criminal with imcompatible justice.
We all know the value of human life; that it is precious as to be worth a lifetime job of rehabilitation. The state should not set the example and be the first to respect the importance of human life.
Here in our country, studies show that there are more crimes being committed by minors these days, that is alarming law enforcement, schools, churches and local government authorities. The picture of everyday scene makes everybody apprehensive, particularly now at this time when there is wide spread, poverty, and joblessness. It only means that, it is so hard to take in a country which prides itself as the only christian nation in Asia and yet, people inside our country still commit crimes that gives other our neighbor country as well as the other country to get an image of us as a country that enjoys in committing crimes and very well-educated in terms of malpractice and ignorance of law with the supposed to be role model society is also one of the enemies of law.
Juvenile Justice with separate home for welfare should be passed to better address the issue of young crime offenders and ensure their rehabilitation prior their release from government custody. Our law, in continues support with the juvenile justice and welfare could also support the minors who are being used by criminals in robbery-hold ups, drug trafficking, prostitution, extortion, snatching and other petty crimes.
So, the urgent execution of this proposal is the only way to protect the minors in committing crimes again and also to give them the right education they should learn that which their parents failed to nurture their child in how to do things with right basis and with right decision.
With the accordance to this proposal minor who found guilty in any crimes should be turned by the policemen in a special and separate place in any branch of DSWD. Because turning these minor suspects to DSWD could only emboldens teenagers to commit crimes.
I believe that if minor crime offenders could be rehabilitate in a much better way with right accommodation and good maintenance of health with special people to guide these young criminals are still capable of becoming productive citizens and could contribute in the development of our country.
If young men could only have a good-education and quality trainings to improve their talents and skills there will be less crime in surroundings. Our country could step ahead and look forward for a better and brighter future. We could compete with other big countries and stand up with the ride of our beloved country, Philippines.
It is time for everybody to work together and craft a comprehensive system to deal with the country’s young offenders. However, the approach must be reform. That’s why I endorse the proposal to set-up ore government “ half way or division houses” where young offenders will be committed and rehabilitated for a step in a right direction.

AMENDING CERTAIN PROVISIONS OF LAW FROM ARTICLE 152 OF THE REVISED PENAL CODE THAT GIVE PUNISHMENT TO YOUNG OFFENDERS FOR CRIMES COMMITTED

Be it enacted by the senate and House of Representatives of Philippines in Congress assembled.

Section 1. It is hereby ordained that Philippine government shall build institutions separately from DSWD.

Section 2. In lieu of returning young offenders into DSWD, these juveniles will be carried into special institution.

Section 3. If any of the provisions of this proposal is declared unconstitutional, the remaining parts not affected thereby shall be in full force and effort.

Section 4. This Act shall take effect 10 days from its publication in at least 1 newspapers or television of general circulation in the Philippines.
