AN ACT
MANDATING ALL OFFICERS OF DEPARTMENT OF INTERIORAND LOCAL GOVERNMENT INCLUDING PUBLIC OFFICERS AND EMPLOYEES UNDERGO DRUG-TESTING EVERY THREE YEARS AND PROVIDING PENALTIES AND PROBATIONS THEREFOR
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
Section 1. Short Title. – This Act shall be known as the “National Mandatory Drug-Testing Act of 2007”.
Section 2. Declaration of Policy – It is hereby declared the policy of the State to protect and be the protector of the rights of the people and to promote efficiency, credibility and integrity in the delivery of public service by ensuring the capabilities of the officials and employees.
Section 3. Definition of terms. – As used in this Act, the following terms shall mean:
Mandating- Commanding all the DILG officers, public officers and employees to abide this Act by undergoing drug-testing every three years.
DILG officers- This includes all officers and employees of Philippine National Police, Bureau of Fire Protection and Bureau of Jail and Penology
Public officers and employees- Refers to any person in the public service as defined under Executive Order No. 292 otherwise known as the Administrative Code of 1987, which includes any person in the service of government or any of its agencies, divisions or instrumentalities.
Drug-testing- The process wherein all the DILG officers, public officers and employees will undergo tests to detect if their body contains substances that came from prohibited and regulated drugs and other similar substances.
Section 4. Probation. - Any DILG officers and employees, public officers and employees found possible of using prohibited and regulated drugs and other similar substances shall be on probation and be placed on rehabilitation centers for recovery and shall be suspended from working or holding any office. And shall be allowed to serve and work again after all the treatments needed and that will be determined by the authorities of the rehabilitation centers.
Section 5. Penalties. - Any DILG officers and employees, public officers and employees that will not or refuses to undergo drug-testing will be suspended for not less than nine (9) months from serving and working.
Section 6. Appropriations. - The funds necessary for implementing this Act shall be charged against the appropriations for Department of Interior and Local Government under the current General Appropriations Act and can also asked help from the National Treasury. Thereafter, such amount necessary for continued conduction of this Act shall be included in annual General Appropriations Act.
Section 7. Separability Clause. - If any provision or part hereof, is held invalid or unconstitutional, the remainder of the law or the provision not otherwise affected shall remain valid and subsisting.
Section 8. Repealing Clause. - Any law, presidential decree, or issuance, executive order, letter of instruction, administrative order, rule or regulation contrary to or inconsistent with, the provisions of this Act is hereby repealed, modified or amended accordingly.
Section 9. Effectivity. - This Act shall take effect after fifteen (15) days after its publication in at least two (2) newspapers of general circulation.

EXPLANATORY NOTE
Our congress has passed the Republic Act No. 9165 or the so-called "Comprehensive Dangerous Drugs Act of 2002" to pursue an intensive campaign against the trafficking and use of dangerous drugs and to protect the people of the State. But we should not forget that public officials and employees were important components of our State. They should also be watch from the use of dangerous drugs and other similar substances.
There were news and cases wherein names of DILG officers and employees and public officers and employees were published and aired on broadsheets, television and radio stations indicating that they were involved on the use of the prohibited and regulated drugs and other similar substances. This news found true degrades the integrity and credibility of government employees, agencies and instrume3ntalities, and also degrades our government system.
Our concern is to eradicate the spread of illicit drugs in the government employees. We, should not, however, forget that government employee dependents is not a criminal but a victim who is in need of medical and psychiatric treatment and still can become useful officers and employees of our government.
In order to put more teeth on this government policy, this bill seeks to castigate also DILG officers and employees and public officers and employees from using prohibited, regulated drugs and other similar substances. Once approved, any officer or employee found positive from the drug-testing will be on probation and temporarily suspended from serving and holding any office in the government.
The approval of this bill into law at the earliest possible time is our paramount concern
