EXPLANATORY NOTE


To provide funds, which shall promote the general welfare and protection of its citizens, and to enable it to finance its multiple activities the government creates taxation. In addition, these funds were the blood life of our government. Without it, our government is incapacitated.
Aside from the purely financing purpose of taxation, it also serves as a tool to carry out the national objective of social and economic development. Like the protection of our local industries against the foreign competition through imposing tariffs. In other words, taxation is one way to regulate foreign industries.
There are many tax measures in the Philippines. Let us take the R-VAT, or the Reformed Value-Added Tax. It is a tax imposed indirectly at every stage of the distribution process on the sale, barter, exchange (including transactions deemed by law as a sale), or lease of goods or properties and rendition of services in the course of trade or business, or the importation of goods. The former 10%VAT was raised to 12 % VAT. Yet, the collections of the Bureau of Internal Revenue are still declining. From the VAT collections during 1996, the BIR’s collection is from 24% down to 10% during 2004.
Moreover, with the President’s projects for this year and the debt services, where shall the government pull its funds?
As we all know, we Filipinos love Hollywood films, movie stars, living the American way and imported goods. For such we buy signature, branded garment which cost big bucks.
In the early years, ukay-ukay are shipped to the Philippines as donations from charitable group to help refugees and help calamity victims. That’s why some of our entrepreneurial Filipino made it as a business, some OFW learned to collect used clothing ,preferably with designer labels, before it to go Ukay-Ukay stores, and send it to the Philippines in balikbayan boxes .
They sell this second hand garment in a more cheaper price but have the quality and designer labels.
This proposal will give equity to other business that was damage due to this Ukay-Ukay stores

An Act imposing 20% VAT on Ukay-Ukay stores and providing mental hospitals higher budget therefore:
Be it enacted by the Senate and the House of Representatives in the Philippine Congress assembled:
Section 1.This Act shall be known as the “Ukay-Ukay tax of 2007”
Section 2.Definition of terms-As used in this Act, the following terms shall mean:
Ukay-Ukay stores-refers to the stores selling used clothing, garment, preferably with designer labels.
Bureau-Bureau of Internal Revenue
Section 3.Coverage-This act shall apply to all Ukay-Ukay stores nationwide.
Section 4.The Bureau of Internal Revenue
A.Ukay-Ukay stores should be register to their respective municipalities or cities.
B. the Bureau of Internal Revenue shall have the full responsibility on the implementation of the Ukay-Ukay tax. The BIR and its registered offices shall have the authority to collect the Ukay-Ukay Tax from the stores submitted by the local government.
B. the Bureau of Internal Revenue shall promulgate rules and regulations regarding the Ukay-Ukay tax.
Section 5.Proceeds of tax collections
A. Collections from the Ukay-Ukay Tax must proceed for the funds of mental hospitals.
B. there shall be an overseeing agency regarding the turnover of funds to mental hospitals.
Section 6.Repealing Clause- All laws, orders, issuances, rules and regulations or part thereof inconsistent with the provisions of this Act are hereby repealed, modified, or amended accordingly.
Section 7.Separability Clause- If any part of this Act is held invalid or unconstitutional, the other parts, or provisions thereof shall remain valid and effective.
Section 8. Effectivity-This Act shall take effect fifteen (15) days from its publication in the Official Gazette or in at least two (2) national newspapers of general circulation, whichever comes first.
